Terms and conditions for purchased services between

MYFIREPHASE GmbH

– hereinafter referred to as "MYFIREPHASE" –

and

the users/purchasers of these services

– hereinafter referred to as "Customer."

§ 1 Scope of application

The business relationship between MYFIREPHASE and the customer is governed exclusively by these General Terms and Conditions in the version valid at the time of the order. Deviating terms and conditions of the customer will only be recognized if MYFIREPHASE expressly confirms them in writing.

The subject matter of the contract is the purchase of services offered by MYFIREPHASE. In particular, the duration of the purchased units and packages is not determined by the purchase.

§ 2 Service description

MYFIREPHASE provides services in the areas of fitness training, coaching, and consulting. Customers receive individually tailored services performed by a MYFIREPHASE employee. It is possible to purchase packages that can be redeemed for corresponding services at MYFIREPHASE.

§ 3 Scope of services

3.1. A training session lasts 60 minutes. The specific procedure and scope of the session are agreed individually with the customer. A health coaching appointment lasts 90 minutes, and the initial consultation as part of health coaching lasts 120 minutes. Your one-off health coaching appointment lasts 120 minutes and includes consultations depending on the customer's focus areas. Further consultations are billed by the hour.

3.2. Both individual lessons and packages can be booked, which are customized individually in consultation with MYFIREPHASE.

3.3. MYFIREPHASE's services include, in particular:

  • diagnostics

  • Individual strength training and endurance training

  • Creation of training and nutrition plans

  • Recommendations for sleep hygiene

  • Recommendations on implementation strategies

  • Advice on menopause in private and professional contexts

  • coaching

Additional offers are also available upon request.

3.4. If third-party services are used, these are not included in the packages offered by MYFIREPHASE. The customer is responsible for all costs incurred in connection with the business relationship or cooperation with third parties and is in a direct business relationship with these third parties. The terms and conditions of these third parties apply.

§ 4 Spatial requirements

The services can be provided by the customer on the customer's own premises or on MYFIREPHASE's premises. If the use of other facilities such as additional sports studios or exercise rooms is necessary, the costs incurred for this shall be borne by the customer in addition, as stipulated in § 8.

§ 5 Prevention and cancellation of appointments

If unable to attend, the customer is obliged to cancel the appointment immediately, at the latest 48 hours before the start. For cancellations less than 48 hours before the appointment, the full fee for the booked session will be charged. Sessions that have already been paid for can be postponed by arrangement and subject to the aforementioned 48-hour notice period.

§ 6 Fitness for sports

In order to achieve the desired training results, it is necessary that the customer is physically fit. By signing, the customer confirms that they meet all the necessary health requirements for training and are free of any limiting illnesses. MYFIREPHASE is not liable for any injuries or damage that occur in connection with the implementation of the training sessions. The customer must immediately report any discomfort, pain, dizziness, or other health complaints during training. The customer assures that they have no health restrictions. If health problems arise during the term of the contract, these must be reported immediately. A medical examination is generally recommended.

§ 7 Liability

7.1. Participation in training is at your own risk.
7.2. MYFIREPHASE is not liable for property damage or personal injury arising in connection with the training sessions, except in cases of gross negligence or intent. In the event of personal injury, MYFIREPHASE shall only be liable in cases of intent or gross negligence.
7.3. Liability for the achievement of the contractual purpose is limited to the contractually agreed service.
7.4. The customer shall be liable for any damage caused to MYFIREPHASE through intent or gross negligence.

§ 8 Remuneration

8.1. For the services listed in § 3, fees will be charged according to the current price list (see ww.myfirephase.de/meinprogramm for customers of the Health Coaching Program, individual training sessions, and one-off health coaching sessions; for corporate customers, prices apply according to individual prior agreement and scope
8.2. Payment is made in advance, by invoice from MYFIREPHASE. The invoice must be paid in full within 14 days of receipt.

§ 9 Copyright

All rights to the training plans, body analyses, and other measurement data created by MYFIREPHASE remain with MYFIREPHASE, unless otherwise agreed. This also applies to publications on the website, flyers, presentations, etc. Use, distribution, or disclosure to third parties is only permitted with the prior consent of MYFIREPHASE.

§ 10 Contract term and termination

The contract generally ends upon completion of the last agreed training session. Purchased sessions and packages must be used within one year of the purchase date. In the event of premature termination of the collaboration, there is no entitlement to a refund for sessions or packages already purchased.

§ 11 Confidentiality

MYFIREPHASE undertakes to maintain confidentiality with regard to all information about the customer that becomes known in the course of training and support measures. This shall continue to apply even after the end of the cooperation.

§ 12 Miscellaneous

There are no further ancillary agreements to this agreement. Terminations, amendments, and/or additions must be made in writing. Should individual provisions of this contract be or become invalid, this shall not affect the validity of the remaining provisions. This also applies in the event of total invalidity or nullity. In the event of even partial invalidity, the parties undertake to find a solution that most closely corresponds to the economic intent and to set this out in writing in a new contract. The waiver of the written form must also be made in writing. The place of jurisdiction is Munich. German law shall apply.
